All services are subject to a written contract signed by both parties prior to the start of any work. Verbal agreements are not binding. The written contract governs the specific scope, price, timeline, and conditions of each project.
Estimates provided by Porterville Sunrooms & Patios are based on information available at the time of the site visit and are subject to change. An estimate is not a guaranteed final price. Final pricing is confirmed in the written contract after a thorough assessment of the project scope.
Changes to the agreed scope of work - whether requested by the customer or required due to unforeseen conditions discovered during construction - will be documented in a written change order. Change orders must be signed by the customer before additional work begins. The cost of any change order will be added to or subtracted from the original contract price.
Free estimates are provided without obligation. Receiving an estimate does not create any contractual relationship between you and Porterville Sunrooms & Patios.
Project start dates are estimates and may be affected by permit approval timelines, weather conditions, material availability, and the completion of prior projects. We will notify you of any significant schedule changes as early as possible.
Cancellation terms are specified in the written contract. In general, any deposit paid prior to permit submission is non-refundable once permits have been applied for, as those costs cannot be recovered. Cancellations after construction has begun may result in charges for work completed and materials ordered or delivered.
We reserve the right to reschedule work due to unsafe weather conditions, including but not limited to heavy rain, high winds, or extreme heat. We will work with you to reschedule at the earliest practical time.
Payment terms are outlined in the written contract for each project. In general, projects are billed in installments tied to project milestones - such as deposit at contract signing, payment upon permit issuance, payment at framing completion, and final payment at project completion.
Final payment is due upon project completion and the customer's acceptance of the finished work. Withholding final payment beyond the due date specified in the contract may result in interest charges and, if unresolved, referral to collections or legal action.
Accepted payment methods are specified in your written contract. We do not accept payment in full before work begins on any project. Any contractor who demands full payment upfront before starting work is not following standard industry practice.
Porterville Sunrooms & Patios handles all required building permits for projects we perform. The customer is responsible for notifying us of any HOA restrictions, easements, property line disputes, or deed restrictions that may affect the project before work begins. Failure to disclose known restrictions may result in additional costs or project delays, which will be the customer's responsibility.
All work is performed in accordance with applicable local, state, and federal building codes. We do not perform unpermitted work on structures that require permits.
Any warranty on our workmanship is specified in the written contract for your project. Warranty coverage is limited to defects in materials and workmanship directly caused by Porterville Sunrooms & Patios under normal use and conditions.
Warranty coverage does not apply to damage caused by misuse, neglect, modification by others, acts of nature, soil movement, settling not caused by our construction, or normal wear and tear. Manufacturer warranties on materials and products are separate from our workmanship warranty and are governed by the manufacturer's terms.
EXCEPT AS EXPRESSLY STATED IN THE WRITTEN CONTRACT, ALL SERVICES ARE PROVIDED "AS IS" AND PORTERVILLE SUNROOMS & PATIOS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the fullest extent permitted by applicable law, Porterville Sunrooms & Patios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or the performance of our services. This includes, without limitation, loss of revenue, loss of data, or loss of use.
Our total liability for any claim arising out of or related to a specific project shall not exceed the total contract price paid by the customer for that project. Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration under Section 11 shall be brought exclusively in the state or federal courts located in Tulare County, California, and you hereby consent to the personal jurisdiction of those courts.
